====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 02-01-2023 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks regular bail in connection with Buxar (T) P.S. Case No. 246 of 2018 registered for the offence under Sections 304, 34 of the IPC.

The prosecution story is that at the behest of ASHA worker, the informant admitted his pregnant wife to Punam Rai's clinic located in Buxar Civil line Mohalla, petitioner operated his wife and when her condition deteriorated, the informant took his wife to Sadar Hospital Buxar where the doctor declared dead.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. She has

Patna High Court CR. MISC. No.14621 of 2022(3) dt.02-01-2023 2/2 falsely been implicated in this case. She has got no criminal antecedent. It is further submitted vide para 6 and 7 of the petition that petitioner is not doctor rather she is manager/care taker of the nursing home and on the alleged date of occurrence, she was not present in the nursing home. It is further submitted that the petitioner is languishing in judicial custody since 21.01.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Buxar (T) P.S. Case No. 246 of 2018 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar.
