JUSTICE MADHURESH PRASAD ORAL ORDER 16-05-2019 The petitioner claims salary for the period May 2003 to April 2012. It is petitioner's claim that during the said period he was working as Regular Amin in the Consolidation Office at Banka.

For the same relief, the petitioner had filed CWJC No. 9658 of 2013. The same was disposed of with liberty to the petitioner to file his representation before the appropriate respondent. The petitioner has placed on record the order issued by the respondent authority dated 27.8.2015 whereby the authority has requested the petitioner to bring documents in support of his claim. There is no pleading on record to suggest

Patna High Court CWJC No.4562 of 2016(2) dt.16-05-2019 2/2 that pursuant to the said correspondence from the Director Director of Consolidation, Bihar, Patna the petitoner has submitted any document. It appears that when documents have been required for revising salary the petitioner has not taken any step to submit the same. On the contrary, he has filed the present writ petition seeking the same relief of payment of salary from May 2003 to April 2012 which had been considered and orders passed in respect thereof in the earlier proceedings (CWJC No. 9658 of 2013.

Such successive writ petition for the same cause of action cannot be countenanced in view of the facts and circumstances where this Court had granted certain liberty on the same plea in the earlier proceeding in respect of which the petitioner has not taken any steps.

The writ petition is dismissed.
