The petitioner seeks bail in anticipation of his arrest in connection with Phulwari Sharif P.S. Case No. 772 of 2017 dated 02.12.2017 instituted for the offences under Sections 147, 148, 149, 353, 341, 323, 332, 337, 338, 295, 295(A), 153(A), 307, 435, 436, 427, 504, 506 and 120(a) of the Indian Penal Code. During the celebration of Urs at a mosque, there was some dispute between the members of the two communities. When the police party tried to restore peace, the accused persons indulged in brick-bats and also damaged property. Their act caused disturbance to the police in performing their duties.

Though the petitioner has been named in the

Patna High Court Cr.Misc. No.16049 of 2018(2) dt.09-04-2018 2/2 FIR but nothing specific has been alleged against him. Prior to the present case, the petitioner was only made an accused in one case under Section 37(C) of the Excise Act.

Regard being had to the general nature of accusation against the accused persons, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge XV-cumAdditional Chief Judicial Magistrate, Patna in connection with Phulwari Sharif P.S. Case No. 772 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
