JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 07-06-2017 Heard Shri Vijay Kumar, the learned advocate for the petitioner and learned APP for the State.

The petitioner is seeking regular bail in connection with Dumraon P.S. Case No. 37 of 2017 for the offences alleged under Section 414 and 34 IPC.

The allegation against the petitioner is that he was sitting in the Scorpio which was recovered as the same was stolen vehicle.

Learned counsel for the petitioner would submit that the petitioner was a passer by and has been falsely implicated in the present case without there being any material to connect with the alleged theft of the Scorpio. He would further submit that the petitioner is in custody since 29.1.2017 and he has got clean

The learned APP opposed the prayer for bail.

Considering the facts and circumstances of the case, let the petitioner, namely, Suresh Yadav be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Dumraon P.S. Case No. 37 of 2017.
