JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2019 The petitioners apprehend their arrest in connection with Manjhagarh P.S.Case No. 295 of 2018 registered under Sections 308, 323, 341, 379, 406, 420 and 504/34 of the Indian penal Code.
Allegation against the petitioner no. 1, as per FIR, is that he had taken Rs. 1,00,000/- from the husband of the informant for providing job and when he has not provided job, husband of the informant asked for money upon which he abused him. Upon protest, petitioners came variously armed. It is alleged that petitioner no. 1 assaulted the husband of the informant by Talwar causing injury and he has also snatched Rs. 2000/- from the pocket of father-in-law of informant.

No.12483 of 2019(2) dt.28-02-2019 2/2 Submission of learned counsel for the petitioners is that there is case and counter case in between the parties and as a matter of fact the dispute is with respect to Rasta and when Panchayati was going on, occurrence took place and injuries are found simple in nature which will appear from Annexure-3. Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Gopalganj in connection with Manjhagarh P.S. Case No. 295 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
