JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-05-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 121A/120B of the Indian Penal Code, sections 25(1-B)a, 26(1) and 35 of the Arms Act, and section 18B and other sections of the UAP Act. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name has figured during course of investigation in confessional statement of co-accused Nandan Mandal on whose disclosure arms were recovered. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent. Petitioner is in custody since 4.9.2021. Investigation is complete.

Considering the rival submissions of the parties, materials available on the record and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate II, Munger in Bariyarpur Police Station Case No. 92 of 2021.
