2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 409 of the Indian Penal Code.
3. As per prosecution case, the allegation against the petitioner is that he has defalcated the government fund meant for students in between 2013-2016.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Earlier, the petitioner had filed a writ petition before the Hon'ble High Court for removal of government encroached land and same were removed but due to which he has

During course of investigation, which has come that at least defalcated amount is Rs. 1700/- which has come in the light of report vide Annexure-E(series). It is further submitted that the petitioner is languishing in judicial custody since 05.09.2022.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Manpur P.S. Case No. 89 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class,Bettiah, West Champaran.
