JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 09.01.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Ishakchak P. S. case no. 42/2014 registered under sections 379 and 411 of the IPC.
Admittedly, name of this petitioner came in this case in the confessional statement of co-accused Vivek Kumar Mandal and stolen CCTV camera was recovered from garage and not from conscious possession of the petitioner.
Accordingly, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two
Patna High Court Cr.Misc. No.875 of 2015 (2) dt.09-01-2015 sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in Ishakchak P. S. case no. 42/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
