The petitioner seeks bail in connection with Garhpura P.S. Case No. 18 of 2017 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act 2016. Learned counsel for the petitioner submits that his name has appeared in the instant case on the basis of confessional statement of co-accused Ravindra Kumar Mahton. The said Ravindra Kumar Mahton has been granted bail vide order dated 03.05.2017 passed in Cr. Misc. No. 20481 of 2017. It is further submitted that the illicit liquor, in question, were admittedly not recovered from the possession of the petitioner. The petitioner is only owner of the vehicle (tempo) wherefrom the illicit liquor has
Patna High Court Cr.Misc. No.25255 of 2017 (2) dt.31-05-2017 2/2 been recovered. Neither the petitioner nabbed from the spot nor any incriminating article has been recovered from his conscious possession. The petitioner is in custody since 27.04.2017 having clean antecedent.
Considering the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl.
