JUSTICE RAKESH KUMAR ORAL ORDER 12-08-2016 The sole petitioner, has approached this court invoking its inherent jurisdiction with a prayer to quash an order dated 1.3.2014 passed by learned Judicial Magistrate 1st Class, Muzaffarpur in G.R. No. 1667 of 2009 , Muzaffarpur Town P.S. Case No. 191 of 2009 registered for the offence under section 420, 467 , 468 , 34 of the Indian Penal Code. By the said order petition filed on behalf of the petitioner under section 239 of the Cr.P.C. for discharge was rejected.

From perusal of material on record particularly the F.I.R. it is evident that the case was instituted on an allegation of misappropriation of fund in the Flood Relief Scheme. Earlier in this case, case diary was called for which has been received and

Patna High Court Cr.Misc. No.20501 of 2014 (5) dt.12-08-2016 2/2 kept on record. After going through the impugned order and material on record I do not find any apparent error warranting interference with the impugned order.

The petition stands dismissed.
