JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-06-2017 The petitioner seeks regular bail in connection with Kaji Mohammadpur P.S. Case No. 45/2017, registered for offences punishable under Section 302 and 120(B) of the Indian Penal Code.
Petitioner is named in the F.I.R and the case is under Section 302 Indian Penal Code.
It has been submitted on behalf of the petitioner that there is nothing against the petitioner save and except suspicion so as to connect the petitioner with the present offence. Further petitioner has been in judicial custody for last four months and other coaccused has already been granted regular bail by this Court vide order dated 09.05.2017 passed in Criminal Miscellaneous No.
Patna High Court Cr.Misc. No.26618 of 2017 (2) dt.22-06-2017 2/3 22178 of 2017.
Heared learned counsel for the State and learned counsel for the informant. They have opposed the prayer for bail. Learned counsel for the informant has submitted that with a view to grab the properties of the deceased, petitioner has committed such an offence. However, learned counsel for the informant could not point out anything suggesting the involvement of petitioner in the said offence.
Having heard both sides, considering the facts and circumstances of the case and also save and except there is nothing against the petitioner and other co-accused of this case has already been granted bail, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzzaffapur, in connection with Kaji Mohammadpur P.S. Case No. 45 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
