Earlier, the prayer for bail of the petitioner was twice rejected by this Court taking note of this fact that petitioner threw acid on the victim but again he has filed this petition for grant of bail.

Submission on behalf of the petitioner is that the mental condition of the petitioner is not fit, therefore, he should be released on bail but I am not at all convinced with the aforesaid submission. Hence, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Session trial no. 415/2016/319/2016 arising out of Akbarpur P.S.Case No. 226 of 2015, pending in the court of learned Additional Sessions Judge-II, Nawada stands rejected.

However, if the plea of lunatic is raised on behalf of the petitioner before the trial court, the trial court shall pass
