The petitioner seeks bail in connection with Khudwan P.S. Case No.47 of 2013 instituted for the offence under Section(s) 147, 148, 149, 427, 302 of the Indian Penal Code. There is allegation in the written report that the husband of the informant and other were traveling in a vehicle and returning back to home. It is alleged that near Chatar More, a strong explosion was reported and the mangled bodies of all the persons seated therein as well as the vehicle were found scattered. The victim has taken the name of 7 accused persons in the written report. The petitioner is not named in the written report. The petitioner has submitted that the name of this petitioner has been disclosed by co-accused, Vijay Singh in his confessional statement
Patna High Court Cr.Misc. No.27049 of 2017 (4) dt.22-08-2017 2/2 during investigation. The Sessions Judge has mentioned in the impugned order that the name of this petitioner has come in the confessional statement of co-accused recorded in para 51 of the case diary. It has been stated that one of the co-accused has been granted bail by co-ordinate Bench of this Court vide order dated 15.06.17 passed in Cr. Misc. No.23967 of 2017. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Magistrate, Daudnagar (DistrictAurangabad) in connection with Khudwan P.S. Case No.47 of 2013 subject to the conditions that both the bailors shall be the close relative of the petitioner.
