This application, for grant of anticipatory bail, arises out of Special Case No. 35 of 2012, arising out of Economic Offence Case No. 20 of 2012, disclosing offences under Sections 420, 465, 467, 468, 471, 120B of the Indian Penal Code and Sections 8, 12, 13(I) (d) read with 13 (2) of the Prevention of Corruption Act, 1988.

Learned Counsel for the petitioner has submitted that as is evident from the First Information Report, there is allegation of issuance of rent receipts in connivance with all the accused persons. As a matter of fact, it was the petitioner's action that the occurrence was detected. It has also been

Patna High Court CR. MISC. No.12344 of 2019(2) dt.01-03-2019 2/2 submitted that similarly situated co-accused persons have been granted privilege of anticipatory bail by various orders, including an order, dated 19.01.2018, passed in Criminal Misc. No. 1412 of 2018.

Considering the above submissions, this application is allowed.

Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance-I, Patna, in connection with Economic Offence Case No. 20 of 2012 (Special Case No. 35 of 2012), subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
