The petitioner seeks bail in connection with Karakat P.S. Case no. 17 of 2018 registered under Sections 30(a), 33, 36 of Bihar Prohibition & Excise Act-2016.

102 lts. of country made liquor, 45 lts. of spirit and electronic machine meant for brewing liquor etc. were seized from the dalan and hut of Manish Kumar and petitioner and Manish Kumar were apprehended.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. He has no concern either with the seized article or with the aforesaid place of recovery. He has

Patna High Court Cr.Misc. No.20808 of 2018(2) dt.16-04-2018 2/2 been falsely implicated in the case by the police merely on suspicion while he had gone to house of his relative located in the P.O. village. He has no criminal antecedent. He has been languishing in custody since 18.01.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-cum-Special Judge-II, Excise, Rohtas (Sasaram) in connection with Karakat P.S. Case no. 17 of 2018.
