JUSTICE BIRENDRA KUMAR ORAL ORDER 21-06-2017 This application is for modification of the order, dated 25.04.2017, passed in Cr. Misc. No. 8617 of 2017 whereby the petitioner was allowed regular bail in connection with Nabinagar P.S. Case No. 145 of 2016 with the condition that the petitioner shall deposit the remaining amount before filing of the bail bond.

Submission of the learned counsel for the petitioner is that for managing the money it is necessary that the petitioner be provisionally released from judicial custody. Prayer is allowed.

The order, dated 25.04.2017, is modified to the extent that the petitioner shall be provisionally released for a period of four months on execution of bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Nabinagar P.S. Case No. 145 of 2016 to the satisfaction of the Chief Judicial Magistrate, Aurangabad, or successor Court. The provisional bail shall be confirmed by the learned Court below if the dues amount is deposited by the petitioner, within four months from the date of release, otherwise the bail bond of the petitioner shall be cancelled by the Court below itself and the Court below shall take steps for arrest of the petitioner.
