The petitioner apprehends his arrest in a case registered for the offence under Sections 363, 366A/34 of the Indian Penal Code.
As per the prosecution case, this petitioner alongwith other FIR named co-accused persons kidnapped the minor daughter of the informant for the purpose of marriage. It is submitted on behalf of petitioner that the victim, in her statement recorded under Section 164 Cr.P.C., has denied the prosecution case and stated that she had gone to Nanighar (maternal house). Police, after investigation, submitted final form.
Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

No.15657 of 2023(2) dt.18-05-2023 2/2 Considering the statement of the victim recorded under Section 164 Cr.P.C., in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO Act, Sitamarhi in connection with Sonbarsa P.S. Case No. 05 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
