Jamua, learned counsel for the petitioner and Sri Uday Pratap Singh, learned A.P.P. for the State. The petitioner is seeking regular bail in connection with Roh P.S. Case No. 11 of 2017 for offence registered under Section 30(a) of the Bihar Prohibition and Excise (Amended) Act, 2016. Learned counsel for the petitioner submits that in the present case the alleged recovery/seizure of the liquor has not been made in accordance with Section 100 of the Cr.P.C. and the coaccused have been granted regular bail by co-ordinate Benches of this Court in Criminal Miscellaneous No. 18422 of 2017, Criminal Miscellaneous No. 16354 of 2017 and Criminal Miscellaneous No. 17191 of 2017. He further submits that the petitioner has got no criminal antecedent and he is in jail since 13.02.2017. He further submits that he is ready to co-operate in trial. Learned A.P.P. opposed the prayer for bail and submits

Patna High Court Cr.Misc. No.25696 of 2017 (2) dt.14-06-2017 2/2 that the alleged seizure has been made from the different vehicles one of which belongs to the present petitioner.

Considering the facts and circumstances of the case, let the petitioner, on completion of two months in custody, be released on bail on furnishing bail bond of Rs. 25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-VI, Nawada in connection with Roh P.S. Case No. 11 of 2017, subject to the condition under Section 437 (3) Cr.P.C. and that the petitioner shall cooperate in the trial.
