JUSTICE ARUN KUMAR ORAL ORDER 30-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 23.8.2017, seeks bail in Kuchila PS Case No. 17 of 2017 registered under Section 414 of the IPC.
The allegation in brief is that the stolen motorcycle was recovered from the possession of one Upendra Yadav, another accused; later on it was disclosed that he purchased the said motorcycle from the petitioner.
Submission is that the motorcycle was not recovered from the possession of the petitioner and Upendra Yadav, from whose possession stolen motorcycle was recovered, has been granted bail by a coordinate Bench of this Court and except the confessional statement that Upendra Yadav purchased the motorcycle from the petitioner there is no other material, and the petitioner is in custody since 23.8.2017.
Having considered the said facts and circumstances, the petitioner, namely, Pappu Mushar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Kaimur at Bhabua in connection with Kuchila PS Case No. 17 of 2017.
