Petitioner seeks bail in a case registered for the offences punishable under Section 30(A) of Bihar Prohibition and Excise Act, 2016.

Father of the petitioner, namely, Rajendra Mahto, who is also co-accused in this case, has already been allowed bail by a Coordinate Bench of this Court vide order at Annexure-2 for the reason that recovery was made from the joint family house and not from physical possession of Rajendra Mahto. Claim of the petitioner is of being on identical footing to that of Rajendra Matho.

Let the petitioner, above named, be released on

Patna High Court CR. MISC. No.11970 of 2020(2) dt.28-02-2020 2/2 bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Hasanpur Police Station Case No.127 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
