The appellant has filed this appeal for grant of bail in Darpa (SC/ST) P.S. Case No. 32 of 2017, registered for the offences punishable under Sections 272, 273, 332, 353 and 34 of the Indian Penal Code and under Section 30(A) of the Bihar Excise Act and under Sections 3(i)(x) of the SC/ST Act. The informant, chowkidar, alleged that the appellant was selling country made liquor to different persons. The appellant was apprehended on chase.

Learned counsel for the appellant submits that nothing has been recovered from the possession of the appellant. The motorcycle was recovered by the side of the road. Considering the facts aforesaid and nature of allegations made against the appellant and the fact that the appellant is in jail

Patna High Court CR. APP (SJ) No.1592 of 2017 (2) dt.24-05-2017 2/2 since 23.04.2017 this appeal is allowed and the appellant above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cum-Special Judge (SC/ST POA) Act, East Champaran, Motihari in Darpa (SC/ST) P.S.
