The petitioner has been in custody since 12.09.2017 in connection with Pipra P.S. Case No. 170 of 2017 for the offence registered under Section 302 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the petitioner was not named in the first information report, subsequently, on the basis of his self confession

made before the police, the petitioner has been taken into custody. It is further submitted that the deceased was the own brother-in-law of the petitioner and there was no enmity between them. It is further submitted that such a confession made before the police has no evidentiary value. Learned counsel for the State points out several paragraphs of the case diary including paragraph 66 which is the confessional statement made before the police and on the basis of such confessional statement, it is stated that paragraph -71 shows that on such confessional statement, the motorcycle and the mobile was also recovered from the house of the petitioner and therefore, there appears to be some complicity of the petitioner.

Having heard learned counsel for the petitioner and upon considering all other facts and circumstances which have come in the case diary including the fact that the deceased had gone to Nanihal for attending some fair and also the fact that the confessional statement made before the police has no evidentiary value and the petitioner is not having any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.

of the like amount each to the satisfaction of Additional Chief Judicial Magistrate -III, Supaul in connection with Pipra P.S. Case NO. 170 of 2017.
