The petitioner seeks bail in connection with Amarpur P.S. Case No. 397 of 2024 instituted for the offence under Sections 341, 323, 307, 354, 379, 504, 506 & 34 of the Indian Penal Code. Earlier vide order dated 10-12-2024, passed in Cr. Misc. No. 84610 of 2024, anticipatory bail of the petitioner was rejected.

The prosecution case in short is that the petitioner along with other co-accused person assaulted the informant and her family members by means of iron rod and also committed
Patna High Court CR. MISC. No.12978 of 2025(2) dt.21-02-2025 2/3 theft of gold ornaments and Rs. 1000/-.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 24-12-2024. Petitioner bears one criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel for the petitioner submits that parties are agnates. There is case and counter case between the parties. So far as allegation of indiscriminate assault is concerned, there is only one injury found, which is grievous is nature. Charge sheet has been submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.
Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Amarpur
