The petitioner seeks bail in anticipation of his arrest in connection with Bettiah Town P.S. Case No. 80 of 2017 dated 01.02.2017 instituted for the offences under Sections 147, 148, 149, 323, 386, 467, 468, 120(B), 471 and 420 of the Indian Penal Code. The accusation against the accused persons in the FIR is that the land which did not belong to the vendor has been sold to the vendee collusively. So far as the petitioner is concerned, he is only said to have identified the vendee as a witness to the sale deed. There appears to be some dispute regarding the title of the land which has been sold by one of the
Patna High Court CR. MISC. No.23966 of 2021(2) dt.13-01-2022 2/2 accused persons.
Be that as it may, so far as the petitioner is concerned, he is only, as noted above, a witness to the sale deed.
For the reasons aforestated, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town P.S. Case No. 80 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
