The petitioner seeks regular bail in connection with Sabour P.S. Case No. 120 of 2016 for the offences punishable under Section 392 of the Indian Penal Code.

The allegation is regarding unknown miscreants having intercepted the motorcycle of the informant and snatched cash from the informant on pistol point.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case on the basis of confessional statement of the co-accused namely Vikash Kumar. It is further submitted that neither any recovery has been made from the petitioner nor the petitioner has been put on T.I. Parade

Patna High Court CR. MISC. No.12492 of 2019(2) dt.28-03-2019 2/2 so as to connect the petitioner in the alleged crime. It is lastly submitted that though, the petitioner is accused in one case, but he is on bail in the said case. The petitioner is languishing in custody since 03.12.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bhagalpur in connection with Sabour P.S. Case No. 120 of 2016.
