JUSTICE ARUN KUMAR ORAL ORDER 29-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 01.01.2015 seeks bail in connection with Bahera P.S.Case No. 100 of 2010 registered under Sections 420, 406, 409, 467, 468 and 471 of the Indian penal Code.
Submission is that co-accused Block Programme Officer under the MANREGA Scheme has been admitted to bail by a coordinate Bench of this Court vide order dated 12.03.2015 and the petitioner is a Panchayat Rojgar Sewak.
Having considered the aforesaid facts and circumstances, the petitioner, namely, Kailash Paswan is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate, Benipur, District- Darbhanga in
Patna High Court Cr.Misc. No.18149 of 2018 (2) dt.29-03-2018 2/2 connection with Bahera P.S. Case No. 100 of 2010 with condition that one of the bailor must be his close family member. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any reasonable cause, his bail bond shall be liable to be cancelled.
