JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 23-09-2015 The petitioner prays to quash order dated 19.6.2013, issued by the appellate authority whereby while affirming order of the Assessing authority, the latter has directed the petitioner to pay the punitive sum of Rs.51,000/- for having excessive load of 69 HP.
I find that the appellate authority has not considered the grounds taken in the appeal and the order does not contain cogent reasons. In the result, this writ petition is allowed. Order passed by the appellate authority is set aside and the matter is remitted for fresh consideration after giving an opportunity of hearing to the petitioner.
