No.03 of 2023 This application has been filed for substitution of the heirs / legal representatives of the sole petitioner, namely, Late Basanti Devi who died on 25.11.2020 and respondent no.2, namely, Gauri Shankar Singh who died on 10.10.2021 leaving behind their heirs / legal representatives stated in Para-2 and Para-4, respectively of the application.
2. The application is supported with the affidavit and the copy of death certificate of sole petitioner, namely, Late
Patna High Court CWJC No.15142 of 2016(2) dt.10-12-2024 2/3 Basanti Devi. The Vakalatnama on behalf of heirs / legal representatives of sole petitioner is already on record.
3. There is no objection on behalf of the appearing respondents.
4. Having heard learned counsel for the petitioner and considering the averments made in the application, I.A. No.03 of 2023 is allowed.
5. Let the names of the heirs / legal representatives of deceased sole petitioner, namely, Basanti Devi and deceased respondent no.2, namely, Gauri Shankar Singh stated in Para-2 and Para-4 of the application, respectively be substituted in their place in the cause-title of this writ petition. In CWJC No.15142 of 2016
6. Heard learned counsel for the parties.
7. Learned counsel for the petitioner submits that this case may be disposed of considering that the proceeding under Section 16(3) of the Bihar Land Reforms (Fixation of Ceiling Area and Acquisition of Surplus Land) Act, 1961, stands abated.
8. Learned counsel for the respondents has no objections to this prayer of the petitioner
