The petitioner has prayed for bail in a case registered for the offence punishable under sections 147, 148, 149, 436, 427 of the Indian Penal Code, section 27 of the Arms Act, Section 3⁄4 Explosive Substance Act and Section 17 of CLA Act. As per allegation in the FIR, petitioner along with 17 accused persons all are member of extremist Sandeep Jee, have blown up the mobile tower.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. General and omnibus allegation has been levelled against him. He was simply a member of the mob. Similarly situated other accused person has already been enlarged on bail by another coordinate

Patna High Court CR. MISC. No.14400 of 2023(2) dt.28-04-2023 2/2 Bench of this Court vide order dated 20.02.2015 passed in Cr. Misc. No. 48888 of 2014. Petitioner is languishing in judicial custody since 11.11.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM 1st, Sherghati, Gaya in connection with Roshanganj P.S. Case No. 54 of 2008.
