JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-06-2017 The petitioners seek regular bail in connection with Gholghardiha P.S. Case No. 126 of 2015, registered for offences punishable under Section 363/366(A)/120(B)/506 of the Indian Penal Code.
Allegation against the petitioners is of kidnapping two minor girls and getting them married with other accused persons of this case.
It has been submitted on behalf of the petitioners that that both the girls have been recovered in this case and their statements have been recorded under Section 164 Cr.P.C., in which they have not named these petitioners. It has also been submitted that in the said statement, one of the kidnapped girls has admitted about her marriage with co-accused person, however, no specific allegation
Patna High Court Cr.Misc. No.25572 of 2017 (3) dt.29-06-2017 2/3 has been made against these petitioners. Further petitioners have been in custody since 10.03.2017.
Learned counsel for the State could not controvert the above submission of learned counsel for the petitioners. Having heard both sides, considering the facts and circumstances of the case and also the girls in their statement recorded under Section 164 Cr.P.C. has not alleged anything against the petitioners, as such, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five) each with two sureties of the like amount each to the satisfaction of learned CJM, Jhanjharpur, Madhubani, in connection with Ghoghardiha P.S. Case No. 126 of 2015, subject to the following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioners will not induce any witness or tamper with the evidence.
(iii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court
Patna High Court Cr.Misc. No.25572 of 2017 (3) dt.29-06-2017 3/3 and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution will be free to move for cancellation of their bail bonds.
