JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 31-08-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 307,34 of the Indian Penal Code and u/s 27 of Arms Act.

Earlier, prayer for bail of this petitioner has been rejected twice. This is his third attempt.

By order dated 20.07.2021 a report from the trial court about the stage of trial was called for which reveals that case is fixed for evidence and out of six witnesses four contested witnesses have already been examined and only the doctor and I.O. are still to be examined.

Considering the progress in trial and nature of

Patna High Court CR. MISC. No.24800 of 2021(3) dt.31-08-2021 2/2 allegation and offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. Since the petitioner is in custody since 18.06.2018, the trial court is directed to conclude the proceedings as soon as possible.
