Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Neemachandpura P.S. Case No. 69 of 2021 registered for the offences under Sections 147, 148, 149, 452, 307 of Indian Penal Code and also under Section 27 of the Arms Act. Allegedly this petitioner, 5 co-accused persons and some unidentified persons surrounded the informant's house and opened firearm towards the doors and windows of the informant's house due to which informant's daughter sustained firearm injury on her thigh.

No.13693 of 2022(2) dt.11-07-2022 2/3 The main submissions advanced by learned counsel for the petitioner are that prior to institution of the present case one namely Bibha Devi who happens to be mother of coaccused, lodged Neemachandpura P.S. case No. 68 of 2021 with an allegation that her son was caused firearm injuries by the accused persons in which the informant's husband was involved and the son of Bibha Devi sustained firearm injury on his chest and he has been made accused in the present case. Further submission is that there is no specific allegation against the petitioner and the investigation has been completed and he has been languishing in jail since 02.12.2021.

Learned APP for the State has opposed the bail prayer. Heard both the sides and perused the FIR of this case. From the perusal of the FIR of Neemchandpura P.S. Case No. 68 of 2021 filed by the petitioner as Annexure 2 it appears that on the same day of institution of present case, one lady namely Bibha Devi lodged the said case against the husband of the informant of this case and some other persons with an allegation that her son was caused firearm injury on his chest by the accused persons. Any specific role of the petitioner has not been mentioned in the FIR and one person is stated to be injured who sustained injury of simple nature on her non-vital part of the

Considering these facts, in my view a lenient approach can be taken in respect of petitioner's prayer let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in Connection with Neemachandpura P.S.
