The petitioner has prayed for regular bail in a case instituted for the offence under Sections 447, 341, 323, 307, 379, 354B, 504, 506 and 34 of the Indian Penal Code. The allegation against the petitioner along with others is of assaulting the informant's husband, due to which he sustained injury. It is further alleged that the accused persons torn her cloths with an intention to outrage her modesty and snatched 6 bhar Silver chain from the neck of the informant. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. The informant's husband is the true brother of the petitioner and resides in one Angan. He submitted

Patna High Court CR. MISC. No.14513 of 2023(2) dt.05-05-2023 2/2 that there is general and omnibus allegation against the petitioner. No specific overt act against the petitioner rather specific allegation of assaulting is against other co-accused. He is languishing in judicial custody since 16.10.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Purnea in connection with Amaur P.S. Case No. 255 of 2022. (Sunil Kumar Panwar, J) arish/- U T
