1. Heard the parties.
2. This is an appeal under Section 101(5) of the Juvenile Justice (Care and Protection of Children) Act, 2015 against refusal of the prayer for bail to the appellant by order dated 03.12.2022 passed by the Additional Sessions Judge-I, Begusarai-cum-Special Court Juvenile Justice Care and Protection of Children Act in connection with J.J.C.P. Case No. 13/2021 arising out of Nawkothi P.S. Case No. 14 of 2020.
3. Submission of learned counsel for the appellant is that the appellant is innocent and has falsely been implicated in this case due to village politics. It is further submitted that the appellant has been languishing in remand home for more than
Patna High Court CR. APP (SJ) No.1132 of 2023(10) dt.02-11-2023 2/2 three years.
4. The report of the Probation Officer suggests that appellant needs proper guidance and counselling for his better future.
5.Having considered the submissions advanced on behalf of the parties and the materials available on record, this Court is inclined to grant the privilege of bail to the appellant. Accordingly, the appellant, above named, be enlarged on bail on execution of surety bond by the sister of the appellant giving undertaking that she will keep proper care and upkeep of the appellant and will fully co-operate in the pending enquiry/trial.
6. The appeal stands disposed of.
