JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 07-06-2017 Heard Shri Soban Asghar, the learned advocate for the petitioner and learned APP for the State. The petitioner is seeking regular bail in connection with Bhairabsthan P.S. Case No. 118 of 2014 for the offences under Section 394 IPC.

The First Information Report as contained in Annexure-1 would show that the informant while going on a motorcycle with a cash of Rs. 50,000/- for payment to a transporter, was intercepted by some unknown miscreants who robbed him of Rs. 50,000/- and his mobile phone. He could not identify the accused but gave some description of their physique. The learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.25387 of 2017 (2) dt.07-06-2017 petitioner has been remanded in the present case on 02.1.2017 but till date no T.I. parade has taken place and nothing has been recovered from the possession of the petitioner. The learned APP opposed the prayer for bail and submits that the petitioner has got criminal antecedent. In paragraph-3 of the application the petitioner has stated about three cases in which he claims to be on bail. Considering the fact that the petitioner is not named in the FIR and the Police has not taken any effort to arrange a T.I. Parade and there is no identification as also any other material, as such, I am inclined to enlarge the petitioner, namely, Abinash Kumar Das @ Guddu Das @ Guddu on bail on furnishing bail bond of Rs.

10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Jhanjharpur, Madhubani in connection with Bhairabsthan P.S. Case No. 118 of 2014 subject to the condition that one of the bailor shall be the family member of the petitioner having clean antecedent and that the petitioner shall regularly appear in course of trial to enable him to conclude the case at the earliest.
