2. The present application has been filed for the following reliefs:
"That this is an application for quashing of the order dated 25.09.2018 passed by the learned Chief Judicial Magistrate, Patna in connection with Kotwali P. S. Case No. 476 of 2018, offence punishable under Sections - 417, 418, 419, 420, 465 and 120B of the Indian Penal code, whereby the learned Magistrate has taken cognizance of the said offences against the petitioner and others."
3. The prosecution case in brief is that the informant Rakesh Ranjan happens to be the Assistant Director, Examination Controller, Employment and Training Bihar,
Patna High Court CR. MISC. No.19515 of 2019(2) dt.30-06-2025 2/2 Patna. According to the F.I.R the informant received information from unknown sources that certain mischievous elements were attempting to commit corrupt/unfair practices in the All India Commercial (ITI) Examination, July-2018, which was to be held from 26.07.2018 to 28.07.2018 in 222 Centers across the State. Based on the aforesaid, the informant lodged his written complaint before the Officer-in-charge, Kotwali P. S. Patna and the Kotwali Police Station registered Kotwali P. S. Case No. 476 of 2018 under sections 417, 418m 419, 420, 465 read with 120-B of the Indian Penal Code.
4. After investigation, charge-sheet has been submitted. At the stage of cognizance, this Court will not enquire into the veracity of the allegation on the basis of the defence materials produced by the petitioner.
5. This application stands dismissed with liberty to the petitioner to raise all the grounds at the stage of framing of charge.
