JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.

It is alleged that the informant and others were sanctioned Rs. 24,000/- each under Indira Awas Scheme in the year 2010 but they were paid less amount and when the informant demanded full money, they were abused by calling caste name. It is submitted by learned counsel for the petitioner that the petitioner neither holds any post in the administration nor he is Panchayat representative and frivolously case has been lodged in the year 2011 for the money sanctioned and disbursed in the year 2010.

Patna High Court Cr.Misc. No.1031 of 2015 (2) dt.12-01-2015 2/2 The aforesaid facts constitute good ground for consideration of regular bail.

Let the learned court below consider the regular bail of the petitioner if he surrenders within a period of six weeks in connection with Simri P.S. Case No. 209 of 2011 pending in the court of learned CJM, Darbhanga.

Accordingly, the application is disposed of.
