====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 19-04-2018 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case registered for offence punishable under Sections 30 (a) and 38 of Bihar Excise Amendment Act, 2016.
It is contended that, allegedly there is recovery of 400 liters of country made liquor from the vehicle which was being driven by the petitioner no.1. The petitioner no.2 was also boarding the same. The petitioner no.1 is said to be the owner of the said vehicle. It is contended on behalf of the petitioner that false implication is apparent as there were two seizures at the interval of 1.15 hours at two different places and the witnesses of seizures are the same. Considering the facts and circumstances of the case, the petitioners, above-named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VII-cum-Special Judge, Excise Act, Aurangabad in connection with Nabinagar P.S. Case No. 49/2018 with a condition that if the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
