====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 16-05-2025 Heard learned counsel for the petitioners as well as learned APP for the State.
2. In this case, the petitioners are seeking regular bail in connection with Kadamkuan P.S. Case No. 916 of 2024,
Patna High Court CR. MISC. No.13049 of 2025(3) dt.16-05-2025 2/3 registered for the offences punishable under Sections 126(2)/115(2)/109/316(4)/352/351(2)/3(5) of BNS.
3. The allegation against the petitioner Shailesh Sharma is that he assaulted the informant with a hammer, causing injuries to different parts of the body whereas the allegation against the petitioner Vimal Das is of catching hold of the informant from behind and pressing his neck.
4. The learned counsel for the petitioners has submitted that the petitioner Vimal Das is brother of Jai Narayan Das. Both the brothers are claiming the management of Thakurbadi through separate will deeds in their favors. The informant is accountant of Jai Narayan Das and he made allegation against the petitioner Vimal Das that he was realizing the rent of the property, belonging to the Thakurbadi on the basis of forged and fabricated papers. It has also been mentioned in the FIR that when the informant inquired from Vimal Das, he was badly assaulted by co-accused Raushan Shukla and Shailesh Sharma (the petitioner). Though the petitioner Shailesh Sharma is alleged to have assaulted the informant with hammer, but the injuries sustained by the injured, are simple in nature. He has further submitted that the injuries caused on head of the informant is attributed against co-accused Raushan Shukla and
Patna High Court CR. MISC. No.13049 of 2025(3) dt.16-05-2025 3/3 not against the petitioners. The petitioner Shailesh Sharma is under custody since 17.12.2024 whereas the petitioner Vimal Das is under custody since 12.12.2024.
5. On the other hand, the learned counsel for the informant has opposed the prayer for bail and submitted that the accused persons badly assaulted the informant and he suffered multiple injuries, to which the learned counsel for the informant replied that those injuries were simple in nature.

Considering the above-mentioned facts and circumstances as well as period of custody, let the petitioners above-named be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class XIV, Patna in connection with Kadamkuan P.S. Case No. 916 of 2024, subject to the following condition that the petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.
