JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-06-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is seeking regular bail in connection with Bachchwara P.S. Case No. 165/2016 registered under Sections 147, 148, 149, 341, 323, 324, 307, 354(B), 379, 504, 506 I.P.C. Learned counsel for the petitioner submits that a bare perusal of the First Information Report would show that so far as the present petitioner is concerned the allegation is that of assaulting the informant on his body by iron rod. He further submits that the injury report, which is Annexure- 4 Series, shows that there is only one injury which has been found to be simple in nature suggesting that there was no injury caused by iron rod. He would further submit that regular bail has been granted to co-accused Ram Pukar Yadav in Criminal Miscellaneous No. 20135 of 2017.

Patna High Court Cr.Misc. No.25521 of 2017 (2) dt.12-06-2017 2/2 Learned APP opposed the prayer for regular bail, however, considering the nature of injury and that the co-accused has already been granted regular bail by a co-ordinate bench of this Court, let the petitioner, namely Amin Yadav be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Bipin Kumar, learned Judicial Magistrate, 1st Class, Begusarai in Bachhwara P.S. Case No. 165/2016.
