JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-04-2019 This is an application for grant of anticipatory bail in connection with Hajipur Town P.S. Case No. 903 of 2014, disclosing offences under Sections 406, 420, 467, 468 and 120(B) of the Indian Penal Code.

Allegation as per F.I.R. is that the accused persons including the petitioner without inviting the tender and for which even a permission of the Standing Committee was not taken and proceeded with the work and as such committed financial irregularity in the whole work and on enquiry that has also been found true.

Submission of learned counsel for the petitioner is that there is no allegation of defalcation rather the allegation of financial irregularity and further the petitioner is the Executive

Patna High Court CR. MISC. No.12975 of 2019(3) dt.30-04-2019 2/2 Engineer of the Nagar Parishad, Hajipur and he has not made any expenditure in this case and further he is ready to abide by any condition imposed upon him.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Learned Chief Judicial Magistrate, Hajipur, in connection with Hajipur Town P.S. Case No. 903 of 2014, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is further subject to the condition that the petitioner shall cooperate in investigation and appeared before the police as and when required.
