The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 354, 363, 366 of the Indian Penal Code. According to the FIR, it is alleged that the petitioner along with other co-accused persons abducted the informant and co-accused Nitesh forcibly put vermilion and solemnized marry with her. The accused persons also assaulted the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to village politics. The present case is counter blast of Dighwara P.S. case No. 183 of 2021 which was lodged by the petitioner. From perusal of case

Patna High Court CR. MISC. No.15537 of 2023(3) dt.13-07-2023 2/2 diary, the victim/informant in her statement, has made specific allegation against co-accused Nitesh and she did not whisper any complicity of this petitioner regarding any physical abuse or misbehave with her. It is further submitted that the petitioner is languishing in judicial custody since 20.12.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Dighwara P.S. Case No. 182 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned IXth Additional Chief Judicial Magistrate, Saran at Chapra.
