The petitioner seeks bail in Buxar Muffasil P.S. case No. 38 of 2016 under Section 395/397 of the Indian Penal Code. The petitioner is not named in the FIR. The learned counsel for the petitioner submits that the name of petitioner figured in the case in the confessional statement of Shankar Kumar @ Shankar and Vikash Mehta, who have already been granted bail vide order passed in Cr. Misc. No. 18390 of 2017. The petitioner was remanded in this case on 07.01.2017 but he has not been put in T. I. parade as yet. Save and except confessional statement of the co-accused, who have already been granted bail, there is no material against the petitioner.

Considering the facts that name of petitioner figured in the case in the confessional statement of the co-accused, who have

No.25550 of 2017 (3) dt.11-07-2017 2/2 already been granted bail, and the petitioner has not been put in T.I. parade, although he is in custody since 07.01.2017, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Buxar in Buxar Muffasil P.S. Case No. 38 of 2016.
