JUSTICE PURNENDU SINGH ORAL ORDER 13-02-2023 Heard Mr. Arbind Kumar, learned counsel appearing on behalf of the petitioner and Mr. Sanat Kumar Mishra, learned counsel appearing on behalf of the respondents.

2. Learned counsel appearing on behalf of the petitioner informed this Court that pursuant to the Letter of Intent, the petitioner was required to fulfill all the requisite criteria as per the advertisement and his declaration made in the application for allotment of retail dealership, but the Authority has not acted upon even though he is ready to fulfill all the criteria. He further informed this Court that till date the dealership has not been allotted to any other candidate.

3. Taking into consideration the specific submission made on behalf of the petitioner, the petitioner, if so advised,

Patna High Court CWJC No.16165 of 2013(2) dt.13-02-2023 2/2 may make a detailed representation before the respondent no. 3The Senior Divisional Retail Sales Manager, Indian Oil Corporation Ltd. Muzaffarpur Division.

4. The Senior Divisional Retail Sales Managerrespondent no. 3 is directed to dispose of the representation of the petitioner within a period of three weeks from the date of receipt / production of a copy of this order after giving opportunity to the petitioner to fulfill all the requisite criteria in terms of the Letter of Intent. In case the petitioner fulfills all the criteria, he may take decision to allot the same in accordance with the guidelines of the Oil Company.
