====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-07-2022 Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner apprehends his arrest in Lakhnaur (RSOP) P.S. Case No. 169 of 2021, registered for the offence punishable under Sections 272, 273 and 34 of the Indian penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

117.500 litres of illicit liquor has been recovered from bush situated behind the house of Jivachh Mahto. It is submitted that petitioner has falsely been implicated in this case only on suspicion. Nothing has been recovered from conscious possession of this petitioner. Petitioner is resident of another village.

Patna High Court CR. MISC. No.13859 of 2022(2) dt.15-07-2022 2/2 Counsel for the State vehemently opposed the bail application and submitted that petitioner has got criminal antecedent of similar nature.

Considering the nature of allegation and quantity of recovery, I am not inclined to enlarge the petitioner abovenamed on anticipatory bail. Accordingly, the same is rejected in view of the provision 76(2) of the Bihar Prohibition and Excise Act.
