This application is for grant of regular bail in connection with S.Tr. No.959 of 2014 arising out of Jamalpur P.S.Cae No.74 of 2013 for the offences under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner and other accused persons is of firing on the injured.

It is submitted on behalf of the petitioner that he has been falsely implicated in this case due to previous dispute and the petitioner is accused in three other cases also and those cases have been filed at the instance of the informant, out of which in one case he has been acquitted.

Heard learned A.P.P. also.

No.25626 of 2017 (3) dt.29-06-2017 2/2 Having heard both sides and from perusal of the record, it appears that the petitioner was identified by the informant while firing on the informant and it further appears that in this case the charge has been framed and the trial has already been commenced. In such view of the matter as well as the petitioner is in custody for about 1 1⁄2 months, the learned trial court is directed to expedite the trial of the petitioner and if possible, conduct it on day-to-day basis and try to conclude it within a period of six months and further the S.P., Munger is directed to ensure presence of the witnesses in the court concerned on the date fixed so that the trial may be concluded within the period as specified and if not concluded, the petitioner is at liberty to renew his prayer for bail.

With the aforesaid observation, this application is dismissed.
