1. Heard Mr. Ajay Kumar Thakur, learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 191(1), 191(2), 190, 126(2), 115(2), 109, 121(1), 121(2), 132, 324(4) and 324(5) of the BNS, 2023.
3. Learned counsel appearing on behalf of the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that he received an information that near Banjara Restaurant at Sahdev Mahto Marg an SUV was parked and 6-7 boys were creating ruckus and disturbing peace by playing loud music, accordingly, the police reached the place of occurrence and saw 1-2 boys sitting in the rear seat of the vehicle and 5-6 boys were standing near the
Patna High Court CR. MISC. No.15498 of 2025(2) dt.02-04-2025 2/3 vehicle. When they were asked to stop playing the music then 34 boys started the vehicle and tried to flee and while fleeing injured the police personnel. Further, 2-3 boys fled on foot while other sat in the car and fled.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner has been falsely implicated in the instant case. It is further submitted that petitioner is not the owner of the SUV which was parked near the place of occurrence from which loud music was being played. It is next submitted that name of this petitioner transpired in the confessional statement of Akash Kumar Singh who has stated that he started the car and fled as such it was Akash Kumar Singh who was driving the car and not the petitioner. It is next submitted that petitioner is a young boy aged about 27 years and if he is sent to judicial custody his entire career would get jeopardized and chances are bright that he may come in contact with the hardened criminals.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned Court below
Patna High Court CR. MISC. No.15498 of 2025(2) dt.02-04-2025 3/3 within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with S.K. Puri P.S. Case No. 351 of 2024, subject to the conditions as laid down under Section 482(2) of the BNSS.
7. One of the bailors of the petitioner shall be his father, namely, Ajay Kumar Singh.
