JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-06-2017 Heard. Mr. Arun, learned counsel for the petitioner, and learned APP for the State.

Petitioner is seeking regular bail in connection with Supaul P.S. case No. 147/17, registered under Sections 454 and 380 of Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. From perusal of the First Information Report it transpires that police seized one mobile of LYF company which is said to have belonged to the informant. Learned counsel submits that the investigation of the present case is over and the charge sheet has already been submitted. Learned counsel for the petitioner submits that the petitioner is a labour working in the NTPC and the recovery of

Patna High Court Cr.Misc. No.25552 of 2017 (2) dt.12-06-2017 2/2 mobile is not from his conscious possession. He is in custody since 30.03.2017.

Learned APP opposed the prayer for regular bail pointed out that this petitioner has got criminal antecedents in one case being Supaul P.S. Case No. 189/2015 under section 452, 380 and 411 IPC. Learned APP submitted that there is a recovery from his possession.

Considering that investigation is over in this case and charge sheet has already been submitted, let the petitioner, namely, Manoj Mehta be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul P.S. Case No. 147/17 subject to the condition that one of the bailors would be a family member of the petitioner having no criminal antecedents and the petitioner shall cooperate in trial and any two subsequent defaults on the part of the petitioner in course of the trial shall lead cancellation of his bail bond.
