JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 26-06-2023 Heard learned counsel for the petitioners, learned counsel for the informant and learned APP for the State. The petitioners have prayed for bail in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 324, 337, 504, 506, 307, 302 along with 120(B) of the of the Indian Penal Code.

As per allegation in the FIR, petitioner no. 1 to 3 stabbed knife to the brother of the informant with an intention to kill. Petitioner no. 4 and co-accused Vivek Kumar Singh assaulted to Brajendra Singh and his father Raj Narayan Singh

Patna High Court CR. MISC. No.14972 of 2023(3) dt.26-06-2023 2/3 with iron rod and butt of the pistol. Due to the said assault three persons, namely, Pawan Kumar, Brajendra Singh Raj Narayan Singh received injury and injured Rajkumar Singh succumbed to the injuries.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Specific allegation for assault to deceased in against Pappu Singh, Satish Kumar Singh and Munna Singh by means of knife, but deceased has sustained only one injury (Annexure-5 Postmortem report). No specific overt act is alleged against the petitioner. They are languishing in judicial custody since There is case and counter case. Petitioners are languishing in judicial custody since 24.11.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJMXIII, Saran at Chapra in connection with Doriganj P.S. Case No.
