JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-03-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 341, 414, 417, 419, 423, 424, 447 and 420 of the Indian Penal Code.

The prosecution case is that the petitioners sold the land of the informant and grabbed the entire consideration amount. It is further alleged that on 01.07.2015 all the accused persons came to the house of the informant variously armed and started abusing and on protest being made, the informant was assaulted by slaps and when the brother of the informant came to rescue then he was also assaulted.

It is submitted by learned counsel for the petitioners that informant is the brother of late husband of the petitioner no.1. In

Patna High Court Cr.Misc. No.10453 of 2016 (2) dt.08-03-2016 2/2 the family partition, petitioner no.1 got the land in question and sold her share of property when after the death of husband of petitioner no.1, the informant is making endeavour to dispossess the petitioner no.1 from her share of property. The petitioner no.2 is the witness to the sale deed. It is further submitted that petitioner no.1 has also filed Complaint Case No. 549 of 2015 against the present informant.

Considering the accusation in the background of dispute with regard to share in the joint family property, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Naugachia in connection with Naugachia P.S. Case No. 162 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
